War Veteran Sues Moore Over "Fahrenheit" Portrayal
Sergeant Peter Damon, a National Guardsman who lost both his arms in the Iraq war, claims the way Michel Moore edited a clip in 'Fahrenheit 9/11' made him look as if he was against the war.

A U.S. war veteran has filed a $85 million lawsuit against Oscar-winning filmmaker Michael Moore for falsely portraying him in the documentary 'Fahrenheit 9/11.'
Sergeant Peter Damon, a National Guardsman from Massachusetts who lost both his arms in the Iraq war, claims the film caused him "a loss of reputation, emotional distress, embarrassment, and personal humiliation" after it featured a clip of an interview he did with NBC's Nightly News.
Damon claims the way Moore edited the clip made him look to be against the war by depicting him as "voicing a complaint about the war effort," when he was actually complaining about "the excruciating type of pain" from his injuries.
Damon is seeking damages in the lawsuit filed in Suffolk Superior Court, Massachusetts, claiming Moore never asked for his consent to use the clip, adding, "(Damon) agrees with and supports the President (George W. Bush) and the United States' war effort, and he was not left behind."
Damon's lawyer, Dennis Lynch, says, "It's upsetting to him because he's lived his life supportive of his government, he's been a patriot, he's been a soldier, and he's now being portrayed in a movie that is the antithesis of all of that."

I know Moore has the Freedom of Speech behind him and we can't stop asshats like him from making the USA as laughing stock in front of the whole blinking world, but I hope this Guardsman gets $85 mil plus and puts Moore inthe poor house.
People have diagreed with government since the beginning of time, especially here in America, take the Boston Tea Party, the Revolution, Civil War and Civil Rights, there were even people who disagreed with World War I and II, but, christ on a cracker!, you don't go out and make your country and it's leaders look like flaming bags of doggie poo just becasue you can. A little respect for the office even if you don't like the guy.:roll:

I don't like Moore's twisting of facts here or at any other time, but I don't like the sound of this lawsuit either.
The movie came out about two years ago. Why wait so long to file?
The clip used belonged to NBC, as it was an interview from one of their shows. Usually when a person does one of these interviews, there's a standard waiver signed in which the interviewee agrees to give the network full rights and ownership to the material. If this was the case, the fact the he wasn't personally consulted before using the footage is perfectly reasonable, no matter what it was used for.
$85 million is a rediculous amount of money for something like this. Being publically humiliated is not worth half that. Even if we assume that this film prevents him from finding employment for the rest of his life (doubtful), its still an outrageous amount of money.
I'm really getting sick of people demanding fat stacks of cash every time their ego gets hurt or someone says something they don't like. I'd be wealthy beyond reason if I did that (assuming I'd win the suits). Taking a quote out of context isn't slander. If it was, every journalist and politician in the nation would be locked up by now.

Only history will show who did more damage to this country: Moore with his twisting of the truth or the Bush Administration with their blatant disregard for it.
Either way, if he pays the 85MM or not, he won’t be in the poorhouse. I certainly hope he continues to produce his version of “the truth”. If you get enough bill-shit piled up on both sides of the scale, there’s a chance you’ll find balance in the middle.

Well try looking at it another way.
Capt. Stamina is interviewed while at the a Renn Faire, by a local tv station. Capt. Stamina is talking about the politics of the kingdom, and refers to Henry VIII as "that doddering fool who will causes the lawlessness that we have seen."
I make a movie about President Bush.
I edit Capt. Stamina's interview, which does not mention Bush at all, is not related to Bush at all, and completely alters the context of what Capt. Stamina says into some venonous attack on Bush.
Now the film is a huge hit, but Capt. Stamina is seen in this movie as advocating the ousting of Bush and making outrageous claims against him.
Do you think that Capt. Stamina's reputation has not been altered by this?
Do you think that corrupting what someone says and making it look like a person is endorsing something they are not should not be punishable?
Now do you see why this soldier has a case against Moore?

I see that moraly the soldier has a case but morals have NOTHING to do with law. Im sorry to say once the rights to someting are sold the originator no longer has any right to the use of that.
Same as artwork... I sell a piece of my work to a publishing company for a specific book cover and give them the rights to the original, now they cna publish that piece as the book cover, use it for another cover, or sell it to antoher company for more money... and I have no recourse.
Now ther might be a slim chance that he could get something for taking his words (or editing) them into a diffrent context... however again the rights have been sold... I do wonder why the wait? It's bee a while sence the movie came out and he won an oscar etc... why now?
Personaly I think Moore is an asshat and his movie was not really deserving of an oscar but then again I feel the oscars are a load of sh*t anyway.

At the very least this case will show people just how slimy he is and expose his belief that he doesn't need to worry about truth or anything silly like that in order to achieve his personal vendetta.

I do find it interesting that Moore and "his ilk" can generate such gleeful hatred when we have the same kind of twisting of truth & facts perpetrated by people like Hannity & Colmes, O'Reilly, Coulter, and the government (no matter the political party), etc... Frankly, I regard pretty much all media and the government with deep suspicion as I think *everybody* has an agenda that's not necessarily in the best interests of this country as a whole.

Wasn't it just like last year Art Buchwald finally settled his lawsuit against Eddie Murphy's "Coming to America?" And that was out in the 80's.
These things take forever.

It took him two years because that's how long Moore jerked him around about settling out of court.
As for what he is suing for.....Moore edited the interview to make it look as if the soldier was against the war. Which is FALSE. As for why it is embarrassing and humiliating. Well....why don't you think of something you support. Do an interview about it. Then someone who opposes your opinion comes along and edits your interview to make it seem that you too, oppose it. Now that person shows that edited piece to millions of people all over the world. Now you have to face friends, family, co-workers (in a soldiers case, fellow military) and people off the street.. ALL of which now have an opinion of you that is the EXACT OPPOSITE of who you are and what you stand for. AND that person makes money off of it. You'd be ok with that? You'd just get over it? I mean seriously. We're not talking about a small scale situation here, like someone says something you don't like or calling you a name. This is on a large scale. It was released in a film that was shown all over the world.
This isn't a frivolous lawsuit like someone who sues because they cut their finger off with a knife that didn't say "caution: may cause injury if run across flesh". :roll:
As for the amount he is suing for. Most lawsuits ask for high amounts because they know that what the ask for will get reduced at decision time, and may even get further reduced in appeals.
I hope the court finds for the soldier, because Moore is wrong for what he did. It doesn't have to be $85 million. I'd be happy for a court to rule that Moore is wrong and make him publically apologize.

I mean, sure, Moore is an irredeemable asshat to the extreme, but all he did was make a movie. There's a significant limit to the amount of influence he can wield.

There's that perception, but I really don't think it's the case. Living in the world of 1500 channels there's so much noise emenating from both sides of the spectrum that it all cancels itslef out. People will listen to the things they were already inclined to believe anyway and ignore the rest. And no matter what it is you believe, at least a dozen of the 1500 channels will agree with you.
Nobody is influenced anymore, only reaffirmed.

Yeah, but even more people made their decision on whom to vote for based on the mistaken belief that Sadaam had direct involvement in 9/11; or based on the belief that letting two people of the same gender marry one another is begging the apocolypse.
Heck, primary voters in one of those fucked up redneck states made their decision on whom to vote for based on whispered false rumors that John McCain had fathered an illegitimate black child (p.s.: thanks, Karl Rove! http://img92.imageshack.us/img92/2971/364si.gif).
People will make their voting decisions based on all kinds of fucked up things. I think you give movies too much credit.

So true on what people use to determine their votes. But there have been many political groups who sided with Moore telling voters... "See!!! Here is the real truth about everything that has happened!!" Do believe Moore even spent many a rally giving speeches as an honored guest of politicians. I do my best each election to look at all that is being said on all sides to decide which way I will vote.

A) Believe me I wished Moore was on the other side of all this. I could have done very well without the guilt by association.

The last 6 years have convinced me that there 'could' have been a better choice than Bush...
I do not believe, however, that Gore or Kerry, were better choices. In fact, I think we would be worse off... And frankly, in more immediate and personal danger.
You can speculate that Gore or Kerry would have done better, but you cannot say for certain...

This country is due for a new revolution. It is no longer a country run "for the people, by the people". It's run by lawyers and business men out for their own gratification and money money money. Funny how our taxes keep going up and their salaries go up with it. Used to be that being a Senator or Congressman was a partime job and you didn't get paid for it just reimbursed for traveling expenses.
We don't just need a new president, we need to go back to basics and clean out the whole Congress and Senate. They shouldn't be allowed to run for office for more than 2 terms, just like the president. This is the biggest issue in my book. They get into Washington and some of them never leave and die in office 60 years later. How effective is a 90 year old Senator anyway? Not to mention the drunken ones. Or the check bouncers? One law broken and you're out on your fuzzy ass!!! These people should be above reproach, not above the law!
This country is ripe for a take over - I say let's take it back before someone else takes it over. We have much the same government as we did when the founding fathers started their Revolution. Taxation without representation. I say this because I don't beleive these people we elected into offoce every listen to us, but do what they think is best. So taxes go up, gas prices go up, they get raises and people like us end up is severe debt andthenstill have to pay additional taxes for the privalige of living here. Something went wrong somewhere.
I agree that Gore or Kerry couldn't have done a better job. Kerry was probably very glad that he wasn't president when 9/11 happened. I think Bush did what he had to and for a short month everyone thought it was right and he was a god. Then of course, the first soldier died and then the reality of war and what freedom actually costs hit home. Now Bush is an ogre and an evil and vile man. He didn't send those kids to war alone. It took an act of Congress and it doesn't matter what was said to have it happen, it happened. Now we need to support it. Funny how the Congress and Senate stood behind Bush one day and said we're behing this man and this country, then when a protest was lodged they all turned tail and started pointing fingers. I don't know about you - but I want a Congress and Senate with back bone running my country, not these turntail cowards who don't want to work and only sit in their offices diddling their secretaries and writing congratulation letters to graduates.

I saw a comic a couple weeks ago that kind of ran along those lines. This student had his picture taken for the School paper he signed a waiver. The article ran it was over so he thought but then another person used this same picture in a campaign saying he was a rapist. Basically they were trying to show that anyone could be a rapist.
Basically what it boiled down to is that he did not sign a waiver saying his picture could be used for the rape article he did for the other and only the other. It was slander. Yeah a comic but still can and does happen in real life. Heck how many times have I heard at fair this year that someone was using someone elses picture as there avator.
So yeah the vet totally has the right to sue. Along the time wise hello how long has it been since Enron and they settled that what last week? Thta was moneywise in the Billions and still not done.

I mean lets face it human nature REQUIRES 'peace thru superior firepower'. It was that way during every great empire of history...
As for healthcare? Think about it, we take ALL the money sent to the starving 4th world countries and set it for American Healthcare... Healthcare paid for... REQUIRED HEALTHCARE... You want a tit job... cough up the cash...

As for Taxes, fuck the IRS and everyone gets a clean slate. After which there is a flat 20% personal tax for every American. NO DEDUCTIONS... you make 50,000? you owe 10k in taxes... Easy, no need for tax preparers...No sales tax on American made items.
Next we teach our kids to win AND to lose... No passing them in a grade so they don't feel bad... No 'both teams win' so no one's feelings get bruised. Teachers can use red pens and tell parents that there kids need to work harder and parents will listen...

Dimitri's platform and ideas would make this a "Star Trek" society. No money, everyone is fed and educated and taken care of. this just gets better and better. How much better the world will be with Rogues and Wenches (and a pyrate here and there just for fun) running the world!!

Not completely true... People would still have and need money... If you can work? You better fucking work... And if you're lazy and want food and medical attention on the governments ticket and your an adult? Guess what, the government expects you to work for your food... Highways need cleaning, police cars need washing... parks need mowing...
Companies will still need to provide health insurance. But if we take the money we send over seas and invest it here, we can get those that can't work the attention they need...
