What an insensative PRICK.
A Spanish driver who collided with a cyclist is suing the dead youth's family $29,300 for the damage the impact of his body did to his luxury car, a Spanish newspaper reported on Friday.
Businessman Tomas Delgado says 17-year-old Enaitz Iriondo caused $20,500 of damage to his Audi A8 in the fatal 2004 crash in La Rioja region, the El Pais newspaper reported.
Delgado, who has faced no criminal charges for the incident, wants a further 6,000 euros to cover the cost of hiring another vehicle while his car was being repaired, El Pais said.
The youth had been cycling alone at night without reflective clothing or a helmet, according to a police report cited by El Pais.
His family won 33,000 euros compensation from Delgado's insurance company after the firm acknowledged he had been driving at excessive speed and this could have contributed to the incident, El Pais reported.
"I'm also a victim in all of this, you can't fix the lad's problems, but you can fix mine," Delgado told the newspaper, ahead of a January 30 legal decision on his suit.
The family said they had previously pitied Delgado for the guilt he must feel at killing their son but were now disgusted that his greatest concern appeared to be money.
"This was the final straw, a kick in the teeth," the youth's mother Rosa Trinidad told El Pais.

What problems, you SOB, the ones you caused yourself when you were driving too fast and killed a young man?
Another case of an adult refusing to take responsibility for his own actions. I guess it's not just happening in this country, seems like it's a worldwide takeover. ::tinfoil:

In one of the more bizarre internet coincidences I've seen, the last thing I saw before I came here last night was a note from a friend of mine who is going through an almost identical situation-- from the other side.
She was driving down the road, and a cyclist pulled onto the road from from a side road without looking. He pulled out right in front of her and there was absolutely nothing she could do. Nothing. She spun out with her windshield smashed, and her glasses gone. Some good Samaritans stopped to help, although it was apparently obvious the cyclist was dead almost instantly at the scene. Thank G-d she couldn't see it.
She's been absolutely devastated by this. It's been almost a year now, and she's been in therapy. She's been going through PTSD. She knows she has to live with it-- even though there was nothing she could have done-- for the rest of her life.
And now? Now the man's family wants a complete list of her assets so they can sue her. They're listing his gloves and shoes and helmet as items for which they should be reimbursed. This man, G-d rest him, caused the accident though his own negligence, but the family wants money from my friend. Apparently, she needs to pay for this all over again.
Times like these I wish I were a lawyer.

I'm glad you posted the other point of view, because I was hesitant to do so myself.
Everyone kinda glossed over the "The youth had been cycling alone at night without reflective clothing or a helmet" part.
Now in this particular case, the guy is a jerk going after the family for compensation, since his insurance covered his liability.
But let's say that he had to have personally paid the family, not his insurance. I don't think it would have been unfair to countersue in order to try and cancel that out, especially since it looks as if he was not considered to be 100% at fault.
I wish to hell that Bernie Goetz had had a lawyer innovative enough to countersue for the PTSD he got from watching four people get shot in front of his eyes (even if he was the one doing the shooting :wink: ).

I'm still waiting to see what happens with my friend's case. I don't think she can afford a lawyer, but I'm afraid she's gonna need one. Badly.

i know some that was crossing a croswalk on green and was hit by an van making a left. (yield on green light). she was shot on the windshield and half over the car befor hitting the ground. she actually died in the emergency room and they brought her back.
he tried to sue her for the broken front window on his van...

How horrible for your friend! I never know what to say in these situations to properly express how this kind of thing makes me feel. I guess all I can say is that I hope the family get's through their grief enough to see that their actions are not going to bring them any peace. And that I will say a prayer for her.
