In summary, the proposed law was to make a mandatory 20 year sentence for raping a child under 12, but got watered down. Victim’s rights organizations have shown up and are pushing to get the stricter sentence put back in. One particular individual, Representative Fagan, a defense attorney, infuriated victims’ rights advocates during a recent House debate when he said he would “rip apart” 6-year-old victims on the witness stand and “make sure the rest of their life is ruined.”

In a fiery soliloquy on the House floor, Fagan said he’d grill victims so that, “when they’re 8 years old they throw up; when they’re 12 years old, they won’t sleep; when they’re 19 years old, they’ll have nightmares and they’ll never have a relationship with anybody.”

I still find it difficult in today's world that anyone would defend a child molester/rapist (of any age)/murderer (of anybody). I know the court systems says everyone has a right to their day in court, but it's times and circumstances like this that makes me wish we still had vigilante law for both the perp and the lawyer.

I'm sorry, but this is just wrong on so many levels I can't count them. :augh::vent: I hope this lawyer's kids or relations are never a victim of any crime or criminal he defended.

I'd rather the crime were committed against the stupid, ignorant lawyer.
That would be justice for what he unleashed, or tried to, back into society.

Yes - it is an awful statement that guy made. Reprehensible in so many ways. However, I am betting it has more to do with him being a defense atty. rather than a Democrat.

While I won't say that every single child rapist on the planet deserves the death penalty, neither do I believe it should be excluded. It should be a case-by-case basis, as it is for other offenses. Applying it universally, without examining the merits of the case, is not justice but a reaction to an admittedly heinous crime.

As for the oh-so-kind defense attorney mentioned earlier, well, he'll get his. I hope he never has to see a loved one ripped apart on the stand as he says he would do. I don't know what it would take to get him to realize what a survivor goes though, but I hope he develops some compassion for victims of abuse.

There is a child rapist sitting on death row in one of the states. I heard that reported earlier today when the Supreme Court decision came down. Yes, it is a case by case basis and it shouldn't be ruled out, but I think the SC decision is based on the death penalty being cruel and unusual punishment for any crime, not just child rape.

I still find it difficult in today's world that anyone would defend a child molester/rapist (of any age)/murderer (of anybody). If there is actual medical/physical evidence proving a rape (in the case of a child), that is one thing. But to go on the say-so of someone else? No. Just as there are women who will lie about being raped, there are children who lie about being molested. Those who are falsely accused have the right and deserve to be defended. It is not difficult to plant false memories in a child - many mothers have done this during divorce hearings.

For the record, I am a survivor of child incest and rape, so I empathize with a true victim. I have no sympathy for liars and feel they deserve to be psychologically shredded on the witness stand.

The falsely accused thing scares me, too. There was a case in CT where a man was jailed for 45 years on abduction and rape charges. After serving 18 years, he finally got a re-trial, and new DNA technology was able to prove it couldn't possibly have been him. He had maintained his innocence all along, but the victim picked him out of a line up, he didn't have an alibi, and the DNA technology at the time, categorized his DNA as "similar". I'm not for badgering child witnesses AT ALL. And I think people that do molest should be prosecuted to the full extent. I think if it CAN be proved, beyond doubt, that they have committed child rape, and especially if they are a repeat offender, the death penalty is appropriate.

O I so agree! And it is hard to decide who is lying and who is not. And the liars make it very difficult for the true victims. If it's real then hot pokers isn't good enough for him/her.

I have no sympathy for any criminal who has been proven guilty, Especially the ones caught with the smoking gun on video tape with eye witnesses. Yeah that really urks me.

I can't remember the show now, but they want to let them out because of no room in the prisons. The prisoner they interviewed said he had an "illness", and offered to be voluntarily castrated, either by drugs or the "old-fashioned" way. At least he was being honest. I think that some states actually DO require chemical castration of sex offenders. But yah know, they have RIGHTS. *eye roll*

A lot of them don't make it too long in prison though. Bit of a high mortality rate, I've heard. :wink:

The problem with castration is that just prevents an erection and in some cases the lowering of testosterone is helpful in preventing a re-occurance. Rapists/molesters and the like aren't committing these crimes because of the sex, they are doing it because of the power and control and you don't need a dick to abuse someone in that way.

I'm not for the death penalty in general, not because I think it's unfair to the criminal, but because the system is too skewed and corrupt and many people in prison are actually innocent of the crime they are charged with. Bad enough to spend several years in jail, worse would be to kill someone who isn't guilty. In cases that they can prove with complete certainty, I think it should be on the table.

A trap, neuter and release program is great for cats, not so much for rapists. :/

Well, I dunno if I'd want it lowered all the way to 12, but there's plenty of horny 15 yr olds who are in danger of prosecution for gettin' it on with their g/f. I believe lowering the age is a sign of the times.

I know I personally think my 14 y/o is too young for sex... BUT ...I'd hate for him to be prosecuted just because of his age, if it is consensual.

You're also right in that I’m not the media. In fact I’m not a member of any party, so I don’t really give a flying fart one way or the other which party this shmuck belong to. I would have posted the article anyway. This is the type of politician that people should be aware of and should be out of office (in my opinion anyway).

And if you read what I posted, I did state that I agreed that there were idiots in both parties, not just the one.

I don’t like either party to be truthfully honest. On a completely unpolitical note, I just saw this on the local evening news, and one of the parks he's suspected of frequenting is right down the street. He's not a rapist, but he was trying to entice two girls into the woods to look for "flying squirrels" in one of his most recent incidents.

The convicted sex offender who police were searching for has been apprehended in Oxford.

Authorities took 38-year-old Michael Hamblin into custody near some railroad tracks on Thursday afternoon.

Investigators believe Hamblin is the man who recently exposed himself to children in Mason, Monroe and Liberty townships.

Police said Hamblin was released from jail last month after he was convicted of exposing himself to children.

Hamblin has been in and out of jail for exposing himself at local stores over the past few years.

The State of Ohio passed "Nicole's Law" after Hamblin was accused of exposing himself to a girl at the Kohl's in West Chester designed to provide tougher penalties for repeat offenders like Hamblin. Stay with WCPO.com and WCPO-TV for updates.

They interviewed Nicole, the girl that Nicole's Law was named for, and she said when she heard he was wanted again she was scared. She also said she just wishes he would stop because, "If he would just put his mind to it, he could stop."
